Been watching it since March. What an exciting moment!
Now waiting for Prop 8.
--Updates, not too surprisingly, the court refused to make a decision:
From the Roberts opinion: “We have never before upheld the standing of a private party to defend the constitutionality of a state statute when state officials have chosen not to. We decline to do so for the first time here.”
--Implications:
The Supreme Court has dismissed Perry v. Hollingsworth for lack of standing, in a decision written by Justice Roberts with Justices Scalia, Ginsburg, Breyer, and Kagan.
The issue: the state is not defending the law, and thus the petitioners do not have standing to defend it. That means the 9th Circuit decision judgment declaring Proposition 8 unconstitutional is vacated. That means that Proposition 8 is struck down based on an earlier judge’s ruling, but the ruling does not have implications for gay marriage nationwide.
Tomorrow or later, it will be CIR bill in Senate. Also a critical time.
